If your organization has a separate written agreement with ZAM, that agreement controls where it conflicts with these terms.
1. Agreement to these terms
By accessing or using ZAM, you agree to these Terms of Service and the Privacy Policy. If you use ZAM on behalf of an organization, you confirm that you are authorized to accept these terms for that organization or that an authorized organization agreement governs your use.
If you do not agree, do not use the Services.
2. The ZAM service
ZAM is an operational workforce platform for organizations operating continuous or shift-based work. Depending on configuration and authorization, the Services may include organization and people administration, workspaces, scheduling, building access, shift handovers, announcements, attachments, synchronization, and notifications.
Features may differ by organization, application version, platform, geography, service plan, technical dependency, and permission. ZAM may improve, replace, limit, or discontinue features where reasonably necessary, subject to applicable customer agreements.
Operational boundaries
ZAM does not replace payroll, human-resources, emergency, law-enforcement, clinical, financial, or physical access-control systems unless a written customer agreement expressly states otherwise. Organizations remain responsible for their operating procedures and for determining which system is authoritative for each business purpose.
3. Accounts, identity, and access
- Use only your own individual account and approved device or session.
- Keep authentication methods and devices secure and promptly report suspected compromise.
- Do not share credentials, tokens, recovery information, or restricted records.
- Access only organizations, workspaces, records, and actions you are authorized to use.
- Organization administrators are responsible for timely membership, role, scope, and device lifecycle management.
ZAM may suspend or restrict access when an account, membership, session, organization, or activity presents a security, legal, or service-integrity risk.
4. Cloud, local, and demonstration modes
Cloud Mode
ZAM Server is authoritative in Cloud Mode. Client applications may cache authorized projections and retry approved commands, but they do not independently determine official records, permissions, or lifecycle state.
Local Mode
Local Mode is separate and intended for development, demonstrations, and approved evaluation. Local information is not automatically uploaded to Cloud Mode and must not be represented as an organization’s official cloud record.
Demonstration workspace
The demonstration workspace contains synthetic information, is available without an organization account in eligible testing builds, and is not intended for real personal, customer, security, or operational information. Resetting the demonstration workspace removes changes made inside that workspace.
5. Acceptable use
You must not:
- Use ZAM unlawfully, deceptively, abusively, or outside your authorization.
- Attempt to access another user’s, workspace’s, or organization’s information.
- Bypass authentication, authorization, rate limits, audit controls, or security protections.
- Upload malicious code, prohibited executable content, unlawful material, or content that infringes another person’s rights.
- Reverse engineer, probe, disrupt, overload, scrape, resell, or copy the Services except where applicable law expressly permits it.
- Use ZAM to make unlawful discriminatory decisions or to conceal, falsify, or destroy required operational records.
- Place real information in a demonstration environment that is designated for synthetic data.
6. Organization and user content
Organizations and users retain their rights in information and content they lawfully submit to ZAM. They grant ZAM the limited rights necessary to host, process, transmit, protect, back up, and display that content solely to provide and secure the Services and meet legal obligations.
The submitting organization or user is responsible for ensuring that content is accurate, lawful, appropriately classified, and supported by a valid purpose and authority. ZAM may restrict content or access where necessary to address security, integrity, legal, or policy concerns.
Operational records may be versioned, archived, or retained as append-only history where deletion would undermine auditability, safety, lifecycle integrity, or legal obligations.
7. ZAM intellectual property
ZAM and its licensors retain all rights in the Services, software, brand, designs, documentation, and technology, excluding customer and user content. These terms grant only a limited, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose during authorized access.
“ZAM,” the ZAM icon, and related product identity may not be used in a way that implies endorsement, ownership, or affiliation without written permission.
8. Third-party services
ZAM may rely on approved identity, infrastructure, storage, distribution, and communication services. Their own terms may apply to accounts or services they provide directly. ZAM is not responsible for third-party services outside its control, but selects and configures service providers according to its security and operational requirements.
9. Availability, updates, and support
ZAM aims to provide reliable Services but does not promise uninterrupted or error-free availability. Maintenance, network conditions, identity providers, app stores, customer configuration, device restrictions, and events outside reasonable control may affect access.
Users must follow their organization’s approved fallback procedures during an outage. A disconnected client must not assume a mutation succeeded unless ZAM confirms it.
Support is available through zamapp.app/support. Service levels, support hours, recovery objectives, and maintenance commitments may be defined in a separate customer agreement.
10. Suspension and termination
Users may stop using ZAM at any time. Organization administrators may revoke memberships and sessions. ZAM may suspend or terminate access for material breach, unlawful use, security risk, non-payment under a customer agreement, or where required by law.
Termination does not eliminate obligations or records that must survive for payment, security, audit, dispute, intellectual-property, or legal purposes.
11. Warranties and disclaimers
To the maximum extent permitted by law, the Services are provided “as available.” ZAM disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation, except to the extent a written agreement or applicable law provides otherwise.
ZAM does not guarantee that information entered by users is accurate or that every configuration is appropriate for an organization’s legal, payroll, safety, security, or regulatory obligations. Organizations must review their configurations and operational outputs.
12. Limitation of liability
To the maximum extent permitted by applicable law, ZAM will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunity, goodwill, or data arising from use of the Services.
Where liability cannot be excluded, the aggregate liability of ZAM relating to the Services will not exceed the amount paid for the affected Services during the twelve months before the event giving rise to the claim, unless a customer agreement or applicable law requires a different limit.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud or willful misconduct where applicable.
13. Organization responsibility
To the extent permitted by law, an organization using ZAM is responsible for claims arising from its unlawful content, configuration, instructions, employment or operational decisions, or use of the Services in violation of these terms or another person’s rights.
14. Governing law and disputes
Unless a written customer agreement states otherwise, these terms are governed by the laws of the State of Kuwait, without regard to conflict-of-law principles. Courts with competent jurisdiction in Kuwait will have jurisdiction over disputes, subject to any mandatory rights or dispute process that applicable law provides.
Before filing a formal claim, please contact admin@zamapp.app so the parties can attempt to resolve the issue.
15. Changes to these terms
We may update these terms to reflect changes in the Services, law, security, or business operations. Material changes will be communicated through the website, application, or customer administrator as appropriate. Continued use after the effective date constitutes acceptance where permitted by law.
16. General provisions
If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign your rights under these terms without written permission; ZAM may assign these terms as part of a business transfer. Headings are for convenience only.
